Abstract

Legal reasoning is concerned with solving particular cases according to general rules. It is a complex cognitive process. The logicist approach proposes an explanation based on logical inference only. Such emphasis on coherence results in a certain indifference to content. On the contrary, extra-logical theories value the contents without dismissing the importance of the syllogism. The hypothesis of this study states that social contents are relevant for legal reasoning in rulings of the Argentine Supreme Court generated between the years 2000 and 2023. A descriptive study was conducted. It employed computational
resources to perform cognitive linguistic analysis. A regression model compatible with the evaluated hypothesis was generated.
It is concluded that social content is relevant. The elaboration of new cognitive models of legal reasoning that integrate logical factors with extra-logical factors is promoted.
