Towards a Situational Paradigm in the Mental Health Care Field

Abstract

The purpose of this article is to analyze the different paradigms of mental health that have taken place in Argentina since the sanction of the first National Civil Code in 1869 to the present day. We focus on the intersection of two dissimilar fields such as health and law. We start from the historical analysis of the legislation in our country, in order to analyze the different terms and principles that have been the structural basis of hegemonic views in the health field, specifically in mental health. To carry out our study, we analyze the paradigm of dangerousness and the current paradigm of risk from a critical and proactive perspective, envisioning new developments towards a situational paradigm.
